When parents of 18-year-old Shaun Malone placed a GPS tracking device into his car to make sure he was obeying traffic laws, I’m sure they hadn’t the faintest idea that the device would go onto to help their son fight an unfair traffic ticket. The model the Malones installed in their car had a special feature that would email them if their car ever went over the speed limit and they could check in real time to make sure their son was where he said he was going to be.
The twist in the tale came when Shaun was caught by a police radar going 62 in a 45 mph zone last summer. But his parents claimed that they had data to refute the claim by police that their teenager was speeding and they decided to contest the ticket by “trial by declaration”. Using the GPS data, the Malones insisted that the radar gun wasn’t properly calibrated and was wrong in its results. However an expert against them claimed GPS wasn’t all that accurate, and this made the judge rule Malone guilty and ordered him to pay up.
But the family appealed and asked the expert to testify in a real trial. This time the expert waxed eloquent in favor of GPS accuracy, claiming that GPS can show speeds within 1 mile per hour. Of course the final decision on the case is still pending but if this story is anything to go by, GPS may soon replace shameless flirting as a surefire way to get out of getting a parking ticket.
